Moreover due to increment of economic globalization and intensification of market competition, trade secrets protection becomes more and more important in protecting enormous economic interests and maintaing core competence by various companies.
This research chooses to regard Hi-Tech industry as the object, the reason that they have incentive to undertake research and development accord with the target of the intellectual property. Perhaps there was much argument over that patent law or copyright law which protect way are appropriate for the intellectual property but in the trade secret protection aspect, the expert and scholars affirms its efficiency..
The thesis successfully approach four fields: firstly, it approaches the Hi-tech industrial regarding the recognition and understanding of the concept of trade secrets, secondly, it approaches the type of the existence of trade secret in the Hi-tech industrial, thirdly, to help the enterprise to establish the management system for trade secret protection. and lastly, find the grey area of trade secret and management. From induction of the study, the research conclusion that (1)A most of enterprise has the lowest recognition of trade secrets; (2)Regarding the type of existence of trade secrets, it could be divided technology secret and business secret and find the characteristic and the attribute of industry will affect the consideration of type of existence and management of trade secret; (3) found the grey area of trade secret in Hi-tech industral has been exist indeed;(4)The management sytem could be difided the people manage and affair manage.
On the base of above, we suggest that The law may give the enterprise in the trade secret certain right, While legal norm''s function has its limit, but stressed excessively legal the restraint suitable hinders culture of the enterprise。The management system of trade secret will be established under the reasonable managed cost, conclude with non-disclosure agreement and sort out the intellectual property, incentives for innovation and widespread diffusion of benefits, in addition punish the immorals behavior.
