碩士 === 逢甲大學 === 財經法律研究所 === 101 === The modes of dispute settlement have always been focused on the researches of international trade studies. A proper dispute settlement mechanism not only plays the most important role in the operation of international trade agreements but also avoids the frictions and arguements between parties. The signature of Economic Cooperation Framework Agreement (ECFA) opens the official window of cross-strait economic and trade negoitations and also promotes mutual understanding and cooperative relationship for both sides. However, due to special political status and economic consideration, the content of this agreement should be regarded under a more thoughtful way, especially the dispute settlement mechanism. This thesis therefore would like to analyze the background and details of the ECFA, and compare this agreement with other existing international trade agreements. Based on current modes of dispute settlement in different trade agreements, some issues would be argued concerning the related provisions of dispute settlement as well as the design of Cross-strait Economic Cooperation Committee under the ECFA. Furthermore, considering the reality of cross-strait, the thesis will critize the application of the ECFA and would like to make recommendations on its dispute settlement mechanism under an equitable and systematic method.
