Summary:碩士 === 崑山科技大學 === 房地產開發與管理研究所 === 103 === Abtract The studies analyzed the co-owned real estate disposal program and problems, and applied the Article 34-1 of the Land Act to standardize the implementation of the main procedures. During the disposal Process of co-owned land, the study stated the related regulations of disposal target range, preferential right to purchase and legacy without applying for registration of inheritance. In addition, the disposal problems of the co-owned land applied the traditional proceedings will be improved with a total solution. The benefit of the creative disposal procedure raised by the current study can quickly complete the procedures; enhance the value of land use. During the disposal process, the study also found that the related laws and norms at odds with the current actual proceedings are incomplete and would impede the proceedings. These issues are also key points arising from the implementation of Article 34 of the Land Law these years and it has not been studied for solving the problems occurred. The study concludes with a number of recommendations to amend the law. We hope the creative disposal procedures can reach the target of promoting the rational use of land, increase the economic value, and further local development. To take care of the rights of all co-owners and reduce future disposition argument are also the benefits of the issues.
