National Health Insurance Act (hereinafter referred to as “NHIA”) is enacted to promote the health of nationals, to administer national health insurance and to provide health service; however, people under sentence were not insured and created equal before. The quality of medical care for inmate was not standardized, and the services were not even available and equitable in certain far-way areas. Besides, the inmates shall prepare budget to pay for any services which the contracted medical care institutions were not capable of dealing with. Since January 1st, 2013, NHIA has been modified to include the inmates. Although there are more medical resources accessible to them, there are still controversies in our medical insurance system. The issue that whether the inmates shall self-cover part of the premiums is questioned strongly by the public. Besides, the increases of the insurance budgets on the reform, the equity of the medical resources distributions, and the emotion of the victims have aroused debates. From the perspective of the Law and Ethics, this study would review on the prison system and the problem from the inmate’s coverage under NHIA, hoping to arouse the public more attention on the non-equivalence condition from the social status. In addition, while the human rights conscious of the inmates has been built gradually, this issue would not be the singly legal issue. It remains to be discussed in many fields in our countries.
