Summary:The evolution of legal positivism which focused on the law as the legitimizing discourse of law for post-positivism represented a paradigm shift since in this model the principles arise with normative force, in this vein, there is the dignity of the human person as legitimizing discourse of the new law. In total harmony with societal values stands the principle of human dignity as a standard principle aimed at protecting the individual in social and legal context. Th e advancement in the fi eld of philosophy of positivism to post-positivism and its infl uence on the vision of the dignity of the human person as the center legitimizing the law represent the crux of this study which has as main feature the demonstration of this paradigm shift, especially in the aspect of verifi cation of human dignity as the north to the hermeneut assuming the center of convergence for all the leg discussion.
