A teoria da interpretação jurídica de Hans Kelsen: uma crítica a partir da obra de Friedrich Müller

O artigo analisa a teoria da interpretaçãojurídica de Hans Kelsen, apresentada na TeoriaPura do Direito, a partir da posição teóricade Friedrich Müller, isto é, a partir das críticasformuladas pela Teoria Estruturante do Direito.Demonstrar-se-á como a distinção entre ser edever-ser, traço fundamental do projetoepistemológico kelseniano, influenciou a teoriada interpretação por ele proposta. Outrossim, opresente trabalho expõe em detalhes a teoria dainterpretação jurídica de Kelsen para, posteriormente,efetuar um inventário das críticas que lhesão formuladas, tendo como fio condutor a obrade Friedrich Müller, sem prejuízo da abordagemde outros autores.Abstract: The article examines the theory of legalinterpretation as presented by Hans Kelsen onhis “Pure Theory of Law”, under the criticalapproach of Friedrich Müller, on his “StructuringTheory of Law” [Strukturiende Rechstslehre].The article shall demonstrate how Kelsen’sdistinction between sein [being] and sollen [shouldbe] – as a fundamental feature of hisepistemological project – influenced the theoryof interpretation he proposed. Also, this workpresents in detail the theory of legal interpretationof Kelsen to thereafter make an inventory of criticsformulated about it, under the guideline from worksof Friedrich Müller, besides the approach of otherauthors.
