Summary:This article analyses arbitrary criteria that affect the rights of the person deprived of liberty in the course of the criminal enforcement process. Based on socio-juridical research, interdisciplinary theoretical reference and institutes as the progression of regime and conditional release, it is approached that the criminal execution is based on arbitrary criteria and results in a social insecurity related to the expectation, concession and access to the rights of the person deprived of liberty.
