Summary:This article analyses the content of the Ruling of the Constitutional Court21/2010 regarding the statutory institutions of the Council of StatutoryGuarantees and the Ombudsman’s Offi ce, and in particular the sectiondeclared unconstitutional: section 4 of article 76 and the fi rst section ofarticle 78. With regard to the unconstitutionality of section 4 of article 76the positions of the appellant and the defenders of the statutory contentare presented and there is a criticism of the arguments for the Ruling andfi nally the declaration of unconstitutionality in that section. It does notshare the criteria of the Court in which the ruling of the Council in the caseof autonomous laws that violate statutory rights may affect the law of participationof MPs in making the laws or the exclusive powers of the ConstitutionalCourt in controlling them. With respect to the rule relating to theOmbudsman’s Offi ce the positions of the opposing sides are also examinedand the criteria of the Ruling is shared on understanding that article 54 ofthe EC does not allows the Ombudsman to intervene in the guarantee ofbasic rights by violating those rights in Catalonia.
