| Summary: | En este trabajo se aborda el debate abierto en Chile sobre la necesidad o no de convocar una Asamblea constituyente para elaborar una nueva Constitución. El autor sostiene que el debate no debería girar en torno a la asamblea constituyente, que es el medio o procedimiento; sino en el fin perseguido a propósito del problema y debate constituyentes: una nueva Constitución, fruto del poder constituyente democrático y sus contenidos normativos iusfundamentales abiertos al constitucionalismo moderno (liberal, democrático y social).
This paper deals with the debate opened in Chile on the need or not to convene a constituent Assembly to elaborate the draft of a new Constitution. The author argues that the discussion should not revolve around the constituent Assembly, which is the means or process; but in the end pursued with regard to the problem and discussion: a new Constitution, result of the democratic constituent power and their normative contents open to the modern constitutionalism (liberal, democratic, and social). |
