Summary:The present paper aims to investigate the amicus curiae institute in the Brazilian legal system, pointing in the New Code of Civil Procedure. Highlight the relevance of its activities to the expansion of the participation in the process in a democracy after the advent of the 1988 Constitution. The scope of this study is to investigate whether the application of the amicus curiae in the process bulge in general contributes effectively to the consolidation of the democratic process model, allowing the active participation of society in all the instances of judgment, allowing the enrichment of the discussion judicial and valuing the Democratic State of Law, in matters of great social interest and collective relevance.
