Summary:The study analyses the importance of subsidiarity of jurisdiction and government intervention in the Roman executive process in order to guide reforms of the modern execution on wealth on the recovery of the principles of roman law. A reduction of judicialisation and a reduction of intervention of the state body, infact, would ensure a return to tradition of Roman law and, therefore, greater efficiency and effectiveness of the modern executive process.
