No. of bitstreams: 0 Previous issue date: 2014-05-22 === The current work is about the religious judicial activism on the decisions of the Supremo Tribunal Federa (STF). On the develepment of this thesis, was necessary to establish the conceptual aspects of the phenomenon called Judical Activism differentiating it of the Judicialization of Politic Política, approaching the confrotation between Law and Politics on the new public arena (social networks) in permanent discussions about social transformations and the constant seach of a stability society. The slowness of legislative power in making and voting the laws that intend to follow the social dinamics of society have influenced the judiciary power on their decisions that, interpreting the constitutional norms, without taking over their competence, intend to give a better guarantee to the fundamentals rights presented on the Federal Constitution. The ascencion of human rights and liberalism made the judiciary power leave some legal aspects to treat, in their judgments, relevant social aspects, beyond the ordinary legal aspects. As a result, the Catholic Church presence in Brazil, its social struggle, since its Discovery, have become a constitutional conquest, including put its religious politics together with the individual guarantee on the Federal Constitution. The objective here is to approach the Catholic Church and the factors that give its religious activism on the Supremo Tribunal Federal (STF) on the medical question of stem cell. Judiciary. === O presente trabalho versa sobre o ativismo judicial religioso no âmbito das decisões do Superior Tribunal Federal(STF). Para o desenvolvimento da tese foi necessário estabelecer os aspectos conceituais do fenômeno denominado de Ativismo Judicial diferenciando-o da Judicialização da Política, aborda o confronto entre o Direito e a Política na nova arena (redes sociais) pública em discussões permanentes de transformações sociais e a constante busca de uma estabilização da sociedade. A lentidão do legislativo em formatar e votar as leis que visem acompanhar a dinâmica social da sociedade tem influenciado o judiciário na tomada de decisões que, interpretando as normas constitucionais, sem usurpar a sua competência, visem dar uma maior garantia aos direitos fundamentais albergados na Constituição Federal em favor da cidadania. Não se trata de uma invasão do Direito pela Política. A ascensão dos direitos humanos e o liberalismo fizeram com o que o judiciário deixasse de lado alguns aspectos legais para tratar em suas decisões de aspectos sociais relevantes, além dos aspectos meramente legais. Em decorrência disso, a presença da Igreja Católica na política no Brasil, a sua luta social, desde o seu descobrimento, se tornou uma conquista constitucional, inclusive, em professar a sua política religiosa juntamente com as garantias individuais estipuladas pela Constituição Federal. Para isso, fez-se uma abordagem da participação da Igreja e os fatores que impulsionaram o ativismo religioso no Superior Tribunal Federal (STF) na questão genética das células-tronco.
