2013_GustavodePaduaVilelaeGouveia.pdf: 1014655 bytes, checksum: 02e587e6da9c308848b7dac3b2510337 (MD5) === A Responsabilidade de Proteger, doutrina surgida em 2001 para resolver os problemas de legalidade e legitimidade das intervenções humanitárias, criou grandes expectativasde que traria maior proteção aos deslocados internos. A nova doutrina, apesar de aindanão ser uma norma internacional, é um poderoso conceito político que poderiacontribuir para assegurar os direitos dos deslocados internos. No entanto, existemdiversos problemas para sua implementação e a doutrina não vem cumprindo a expectativa de evitar ou solucionar os deslocamentos forçados em massa. Torna-se imprescindível, portanto, repensar a Responsabilidade de Proteger, de modo acompreender quais aspectos da nova doutrina podem contribuir para a proteção dos deslocados internos. Defendo que a melhor forma de protegê-los é fortalecer sua dimensão mais importante: a Responsabilidade de Prevenir. As medidas de prevenção,contudo, para serem eficazes e legítimas, têm de ser pautadas pela dimensão local e pela ética discursiva. _________________________________________________________________________________ ABSTRACT === The Responsibility to Protect, proposed in 2001 so as to resolve the problem of thecontested legality and legitimacy of humanitarian interventions, has generated hopesthat the new doctrine would bring better protection to the internally displaced persons(IDPs). This doctrine cannot yet be considered an international norm, but a powerfulpolitical concept that could contribute to ensure IDP´s rights. Nevertheless, there aresome problems to implement the doctrine, which undermines its strength and itscapacity to prevent or react to mass forced displacement. Therefore, rethinking theResponsibility to Protect is indispensable in order to understand what features of thenew doctrine can contribute to deal with forced displacements. I defend that the bestway to protect the IDPs is to strengthen the most important dimension of the newdoctrine: the Responsibility to Prevent. However, the adoption of preventive measuresmust be grounded in the local dimension and the discursive ethics, which grants themefficacy and legitimacy.
