This type of research was chosen by the interest to put in check the existing legislation and be what more adapt to the objective of the survey. The specific objective of this research was basically the confront the applicability of the existing legislation relative to protection of fundamental rights and duties and the problem of violence against women in famíilia in both countries: Mozambique and Brazil. === A presente dissertação, vinculada à linha de pesquisa em Criminologia e Controle Social do Programa de Pós-graduação em Ciências Criminais da Pontifícia Universidade Católica do Rio Grande do Sul, pretendeu investigar, verificando a partir dos instrumentos internacionais de proteção da mulher, em que medida as normas e os instrumentos legais existentes no Brasil e em Moçambique, direcionados para a proteção da mulher contra a violência no âmbito familiar, são eficazes para a garantia desses direitos. Trata-se de uma pesquisa qualitativa e de tipo documental. Este tipo de pesquisa foi escolhido pelo interesse em verificar a legislação existente e por ser o que mais se adecua ao objetivo da pesquisa. O objetivo específico desta pesquisa foi fundamentalmente verificar a aplicabilidade da legislação existente na proteção dos direitos e deveres fundamentais e o problema da violência na família contra a mulher nos dois Países: Moçambique e Brasil.
