However, in the first part of this paper shall-to-be an analysis of fundamental rights, because they are the pillar of the whole study, following, for an examination of the rights of personality, with emphasis on human dignity, noting, still, the erosion of the guilt element and causal link, important axes of the civil liability, which is worn out and gives opportunity to several types of new and recoverable damage. Lastly, a connection of all these topics is made, since the objective of this study is to think about the possibility and the consequences of increasing the immaterial damages repairing to a constitutional level, both by the current lack of systematization and by the abrasion of the Civil Code on the matter. === O presente trabalho versa sobre a ligação que se pode fazer entre a reparação de danos imateriais e os direitos fundamentais, com o intuito de alcançar a essa reparação o semelhante e significativo status constitucional que já possuem os danos imateriais. Para tanto, em um primeiro momento, far-se-á uma análise dos direitos fundamentais, pois são estes o pilar de todo o estudo, passando-se, na sequência, para um exame dos direitos de personalidade, com ênfase à dignidade humana, constatando-se, ainda, a erosão do elemento culpa e nexo causal, importantes eixos da responsabilidade civil que, desgastados, dão ensejo a vários tipos de novos e ressarcíveis danos. Por fim, faz-se uma união de todos esses tópicos, uma vez que o objetivo deste estudo é refletir sobre a possibilidade e sobre as consequências de se elevar a reparação de danos imateriais a um patamar constitucional tanto pela sua atual falta de sistematização como pelo desgaste do Código Civil acerca do assunto.
