creasing numbers of petitions on neighborhood disputes caused
by harmful construction, both the Contractors and neighbors''
rights are directly affected. Poor management has not only
created a waste of social resources but also an
increase of civil complaints. Currently, relevant
governing authorities in many cities and counties lack
a comprehensive and justifiable legal mechanism to deal
with such petitions. Neighbors whose rights have been
damaged do not have the knowledge to appeal to the governing
authorities for help. These may have caused puzzlement among
the government employees and unnecessary misunderstanding
between petitioners, and administrative agencies. This
research, based on a review of former studies,
questionnaires completed by petitioners, interviews
of administrators, a collection of relevant data and
statistical analysis, is to explore current ways handling
petitions on neighborhood disputes caused by harmful
construction. It attempts to establish a managing mechanism.
Appropriate to the needs of Taichung City so as to solve
the cases quickly, economically, fairly, reasonably and
effectively. The study highlights the following four parts:
1.To analyze the characteristics of the petitions
on neighborhood disputes and to draw conclusion from
the analysis. 2.To review the defects and disadvantages of
local policy on handling petitions and use them as
references when revising the managing policy. 3.To explore
issues pertaining to the mechanism on managing neighborhood
disputes and use them as basis for establishing a new legal
mechanism. 4.To set up a legal mechanism for handling
petitions on neighborhood Disputes caused by harmful
construction and to propose a comprehensive prototype managing
mechanism.
