The effective implementation of military construction depends not only on the technical aspects, but also most importantly, on the scopes of law and the vague definition of military construction. With regard to the later, there are few discussion and investigation. In this pioneered research, the role of military construction was fully investigated under current construction laws and its relevant standards. Suggestion to improve the current situation was proposed. There are several conclusions：
(1) The military constructions do not belong to the generalized category of the Public Works.
(2) Neither can they implement efficiently and effectively, nor can be protected under current laws regarding to the Public Works.
(3) The smooth deployment of weapon systems is based on the smooth execution of their facilities engineering and management.
(4) The effective implementation of construction projects depends, importantly, on its high quality legislation on the upper stream.
A “Regulation on the Recognition of the Emergency and Secret Military Construction for National Defense” under “National Defense Act” was proposed. It will improve and protect the future implementation of military construction projects.
