碩士 === 國立臺灣大學 === 法律學研究所 === 89 === The merger regulation and practices in Fair Trade Law have to be examined and amended .By the mergers in the financial industry for example, this article try to discuss these questions as follow; The coexistence und interaction between Competition law and regulation law; The definition of merger; the threshold of an application for approval; The definition of the relevant market in financial industry; The influence of technological development and globalization on anticompetitive effect; the impact on the competition due to the formation of Financial Conglomerate, the merger between financial und industrial enterprises; what kind of role industrial policy plays when the Fair Trade Commission consider whether or not the overall economic benefit of the merger outweighs the disadvantages resulted from competition restraint; and How the Fair Trade Commission consults with other ministry or commission (eg. Ministry of Finance) to deal with the cooperation and exclusion in regulation law.
