In addition, china is still regarded as a non-market economic on antidumping cases from the United States and Europe Union’s perspectives. Thus, it’s important for Taiwan to replicate the experience of the United States and Europe Union in order to improve Taiwan’s current antidumping regulations. This thesis has three objectives: First, is to analyze the economic characteristics of non-market countries and china as well as their difficulties to apply the antidumping laws. Second, is to explore the experience of the United States and Europe Union on dealing with antidumping cases on the non-market countries and china. Third, is to discuss how Taiwan replicates these countries’experience to improve it’s antidumping regime. The thesis finds that the experience of the United States and Europe Union on dealing non-market countries and china on antidumping cases do provide Taiwan some helpful inspiration. Taiwan has to replicate these techniques such as setting up the criterions on identifying a non-market country、the factors of choosing surrogate countries、the methods of determining dumping margin and the market oriented industry approach in its newly enacted antidumping regulations. Since Taiwan is closely becoming a WTO member, it has to fasten it’s pace to improve it’s antidumping law regime in order to reduce it’s impact on the WTO accession.
