IC industry in Taiwan was begun at 1970’s, and it grew up sharply at 2000’s. It takes the economy of our country grow to maturity and strengthen the national competences. Appropriately the resource-based view can provide an external sight to investigate how the semiconductor industry can get the sustained competitive advantages. Under the strategic logic of resource-orientated, the advantage of competition was made from two parts integrated: It makes the basis with resources, and the competence is to use and bring resources into full play. In the studies of core competence of IC industry in Taiwan, the ones which were related to technology were as follow: control capability of product yield, manufacturing capability of throughput, control capability of process, and research and develop capability of technology. Excellent process-technology competences symbolize high-quality and well-tech nology for IC industry in Taiwan, and it has positive effect for operating income. However, business can’t bring capability into full play because of the patent-right problems involved in the products or process-technology. Moreover, the illegal use of patent-right will result in the claim of huge amount of royalty payment or the accusation from leading companies. It will force them losing the competence of market or can’t stand a load to competing against others and then will being withdrawn. For this reason, this study bases on resource-base theory, and takes innovation to nature. And then, this study modifies Afuah’s “Profit Chain Model” as theory framework a little bit. In order to build the relationship model, it has to discuss the relationship among process technology competence, patent right and performance for IC manufacturers in Taiwan. It will help business to face squarely or realize the patent value with patent analysis. The result of this study shows that the model can be established successfully. It was proven that patent right has direct effect to performance, and interaction relationship among process technology competence, patent right and performance is closely. If the business can pay attention on the establishment of patent, it will help the protection and development of process technology, performance of business increasingly, and having the outstanding competitive advantages. Then it verifies that the theory of Afuah: “ The business can accumulate endowments in the process of developing capabilities, and endowments will also enhance the competence which the business supplies different and low-cost goods.” Besides the establishment of model, the study’s contribution is that it provides a reference, which the subject of patent analysis was focused on process and takes the category of company as the principal part of analysis. It will emphasize the patent difference among companies. In many management theses of the semiconductor industry, this study takes the lead in bringing patent right analysis into business operation level. And by the empirical study of Afuah’s model, it brings another viewpoint to the semiconductor industry. Patent related information could help business recognize their own competence, assets, and key success factors in order to maintain the sustained competitive advantages. The management meaning of this study is shown as follow: 1. Indeed, advanced process technology is key success factor in IC manufacturers. It not only can announce R&D capability of company’s technology but also has contributions of real income. So the authorities should promote their own process technology competence continuously. 2. The patent management of business and the policy of development were closely linked. When the business get the disposal and performance of technology resources, the patent right should be taken into consider. Semiconductor manufacturers belong to capital- intensive, technology-intensive industry. Having innovative process patent will not only promote yield and reduce cost but also increase income in opposition to expensive facilities input and complicated manufacturing procedures. 3. Process technology competence of the semiconductor industry refined day by day. No matter process procedure and technique can improve continuously. The result accumulated in improve process will transfer to apply the patent, and it makes patent quantity increase. Oppositely, increase of patent quantity expresses that it was formed monopoly advantage to some technology competence of process.
