Summary:碩士 === 義守大學 === 管理科學研究所 === 91 === Abstract Government Procurement Law was officially implemented on May 27, 1999. The law focuses on the procurement of properties, labor services and construction projects made by government departments, public schools and public utilities, and sets norms for the procurement measures from public bidding, determination of a contractor, management of contract fulfillment, inspection and acceptance, objection and complaint, etc. Its functions are stated in Substantiality Law, Procedures Law, Relief Law, etc., whose contents are almost similar to the Government Procurement Agreement of World Trade Organization (WTO) and Government Procurement Standards of Europe and the United States. It can be called a statute book of improved government procurement. As the government business has been expanding in the modern days, how to maintain the small but exquisite government to accelerate its administrative efficiency, and how to maintain the superiority of administration are import subjects. Perhaps outsourcing of government business is a new opportunity. What kind of business can be outsourced? What is the correlation between outsourcing and Government Procurement Law? This research aims at taking the observations on the outsourcing of urban plan business as the core of discussions, and attempts to solve the above-mentioned problems. The contents of the research mainly include the following five points: 1. Investigate the demand of urban plan business. 2. Investigate the legitimacy of the outsourcing of urban plan business. 3. Investigate the relationship between urban plan business and Government Procurement Law. 4. Investigate what impacts the implementation of Government Procurement Law inflicts on the outsourcing of urban plan business, and what the solutions are. 5. Give conclusions and suggestions. The research results show that: 1. The supervisory departments should pay attention to the demand for and importance of the outsourcing of urban plan business. 2. If exertion of public authority is not involved, the outsourcing of urban plan business should be encouraged. 3. The outsourcing of urban plan business should be applicable to Government Procurement Law in the first priority. 4. Strengthen the expertise of urban plan proposals, and consider the authorities and benefits of private companies so as to get a win-win situation to both public and private sectors.
