碩士 === 銘傳大學 === 公共管理與社區發展研究所碩士在職專班 === 91 === The penalty of drunk driving of our nation has been changed from common administrative punishment into serious administrative penalty and penalizing stage since 1999. The result of crucial penalty only reduced drunk driving death rate negatively, but the behavior of drunk driving still prevailing. Hence, serious penalty policy can not restrain drunk driving behavior effectively; Even government added the social cost of drunk driver continuously. The annual prohibit drunk driving cases of the police were not obvious declining under prediction. The accumulative law and penalty criminal policy not only reduce drunk driving behavior persistently, but also spread out many social problems, it is the root of this research motive. From the real side of social reality, penalizing and serious penalty policy were not satisfactory since it’s implementation from 4 years begin. This research focus on the executive problems after penalty policy changed, utilizing content and date analysis, to dissect the means of drunk driving behavior and policy vicissitude and statistic date 3 also, to utilize fully inquisition methods to prove research notes according to related meeting analysis and paper exploration. The research found: in one side, drunk driving behavior has specific social and economic background, penalty policy were incorrect indeed; penalizing are not panacea to restrain drunk driving behavior, to substitute penalty with decriminalization and crucial administrative punishment, also coordinate other policy control and propaganda measures can result the problems thoroughly, on the other hand, due to inefficient civilian discipline consciousness,「delay-prosecution system.」can be the substitute policy before decriminalization. Previous exploration for policy subject should contribute for the research.
