This paper contains three parts :(1)the organization and authority of the Coast Guard Administration, (2)the jurisdiction territory of the Coast Guard Administration, (3)the executive measures of Coast Guard Administration.
The Coast Guard Administration is a new organization established in 2000. It is reorganized and composed of Maritime Police Bureau National Police Agency, Ministry of the Interior, the anti-smuggling vessel and officials of the Custom, Ministry of Finance and the Coast Guard Troops of the Ministry of National Defense. However, the legal status of the Coast Guard Administration and the officials need to be clarified.
The Coast Guard Administration is the organization of the law enforcement at sea .The sea is the mainly place where law enforcement of the Coast Guard Administration. But the sea place contains part land near sea. Besides, due to the special relationship between Taiwan and Mainland China, the law enforcement at sea of the Coast Guard Administration has difference of the space and the object.
In December 2002, the Judicial Yuan of R.O.C. enacted Grand Justices Council Reporter resolution NO. 535, which has a deep influence on the police action of inspection. The Coast Guard Administration is the exclusive organization for law execution at sea in our country, and the officials of the Coast Guard Administration can use administrative inspection as the police on the land. Meanwhile, this paper will also discuss the administrative inspection of the officials of the Coast Guard Administration at sea.
