| Summary: | 碩士 === 國立臺北大學 === 公共行政暨政策學系 === 92 === Religion Autonomy and the seperation from politics and religion are the two important rules for modern countries in making religious groups rules . Since the Judge declare that the supervision temple orders are violated the Constitution, disobeyed religion autonomy and religion equity, exposed the problems and dilemmas now religious groups faced , so it is necessary to make rules for religious groups.
The main purposes of the research are as follows:
1.Disclose the problems of the religious groups in order to solve those problems as reference for rule making: We have to discuss the problems religious groups face such as religious consultation committee , open financial situations , research institutions , corpse containing tower, and religious buildings.
2.Convergence:For the four editions, we have to make disagreements to agree in order to get the convergent conclusion.
3.Conforming to the equity justice principle , striving the balance between the right and the obligation.
The suggestions of the research are as follows:
1.Registration and accountability : In order to make religious groups to get legal person qualification, enjoying the rights and shouldering the obligations, we assert that religious legal person should take coercive registration ,making regulations for religious groups ,asking them for accountability in the religious groups laws, and that is suitable for all religious groups .
2.The balance principle and the public interest :It includes the balance between the right and the obligation, the tax equity principle, emphasizing public interest adhering to social equity and justice.
3.Social responsibility of nonprofit organizations:Religious groups ought to engage in public interest , charitable ,social welfare enterprises. In the religious groups law, it should set laws formulated that religious groups income from donation ought to submit fixed proportion income as social public interest facilities.
4.Ericate the interruption of political power, expounds the force of the fourth power and social public opinion supervision .
5.Only good concepts can not put practice ; Only laws can not implement. . Good concepts and laws should have related complemently measures.
6. The consideration of penalty :If religious groups raise money illegally, puppeting papers, deceiving money and body,religious groups should be fined or mandated to dismiss.
