Summary:碩士 === 逢甲大學 === 經營管理碩士在職專班 === 94 === In order to assist the domestic economic development and society demand, the numbers of foreign laborers in our country have increased fast constantly, that have already exceeded 320,000 in a set of the total number of person, since the introduction of the foreign laborers in 1980. The fast growth among them is the foreign caretakers in which accounts for 1/3 of the total number of foreign laborers. These foreign caretakers undoubtedly have quite great contribution to Taiwan’s economic development. However, looking around the situation of the present foreign caretakers of Taiwan, the problems such as forging the physical examination testimonial, sex infringement, illegally employment, job calamity, working overtime, running away, intermediary exploits, repatriating, discriminating against by agency are still emerging in an endless stream. Though our government keeps revising the relevant laws, the basic human rights of foreign caretakers have not been improved obviously. Therefore, the study attempts to probe into the foreign caretakers’ problems and challenges based on the news from United Newspapers between year 2002 and the end of October of year 2005. We comprehend various kinds of problems by case study which foreign caretakers face and make suggestions for improvement. We propose the following conclusions according to the result of this research: (1) The government should get involved and improve the foreign caretakers’ condition, and to standardize the foreign caretakers to sign agreement bilateral agreements with employers to ensure the foreign caretakers basic rights. (2) The government should speculate again about difficult role that the foreign caretakers play, and expand the scope of application of the Labor Standards Law to the foreign caretakers. (3) A long-term goal should be set up for a formal treatment service system for elders’ needs.
