Palestinian occupied by Israel is always the issue of political confrontation in the Middle East. The critical point of conflicts between Israel and Palestinian Arabs is the creation of an independent state of Palestine. Despite the Camp David Accords signed between Israel and Egypt through the mediation of the U.S.A. in 1978, disputes between Israel and the Palestinian Arabs have not yet been solved. In 1993 and 1995, two Oslo Accords (Oslo AccordⅠand Oslo Accord Ⅱ) signed respectively between Israel and the Palestine Liberation Organization (PLO) have brought the dawn to a new age. The Palestinian National Authority has gained the right of self-rule in six cities along the West Bank and Gaza Strip in 1995. However, the Palestinian National Authority doesn’t possess the features of a sovereign state. Also, mutual distrust and violation of accords signed between them have hindered the real implementation of Oslo Accords. The purpose of this thesis is to analyze the status of the PLO and the Palestinian National Authority from the perspective of international law. The contents of this thesis begin with analysis of issue of the Palestinian state and end with its legal status. The whole thesis focuses on the development of Palestinian into an independent state and its current legal status. It includes the Balfour Declaration of 1917, the Partition Plan of Palestine of 1947 and two important battles of 1948 and 1967 which all have great influence upon the legal status of Palestine later. Establishment of the PLO is also an important factor regarding international legal status of the Palestinian State. Besides, establishing the Palestinian National Authority and its correlative questions in international law form the bases of judging whether or not it enjoy international legal personality and whether or not it’s a subject of right and obligation in international law.
