If the construction engineers do not have a detailed and complete contract of the project before the construction begin, they will not be able to protect their benefit after the engineering dispute occurs. It is necessary for the engineers to learn about the laws of engineering. Arbitration that handle dispute spent less time and money than litigation. My thesis starts by introducing the procedure of engineering arbitration and identify the important relevant factors, followed by an analysis of the arbitration procedure and their legal effects. A survey of engineer experts is used in analyzing the essential factor of the engineering arbitration. The thesis is divided into the following chapters: Chapter 1 Introduction Chapter 2 Currently used arbitration system The chapter states the past history of arbitration, the law sources of arbitration, arbitrating situation at present, the arbitration agreement establishment, the methods to adopt an arbitrator and the characteristics of arbitration. Chapter 3 Case study The chapter mainly looks into the background of the construction on arbitration, identifies the position of arbitration in law and the disputes on each case. Chapter 4 Results and analysis The chapter continues the statistical analysis of the survey by using the suit software (SPSS) to analyze: project resources and social environment, contract administrative, planning and design, project construction, and confirm partly and system of arbitrating carry on statistical analysis. Chapter 5 The main factors in Arbitration The chapter gathers the result received in the investigation, the content that each analyse is described systematizedly. At last, the important factors that the influence arbitration are listed. Chapter 6 Conclusion I-jyn Wen Nan Su 文一智 蘇南 2006 學位論文 ; thesis 124 zh-TW
