Upon the demand of maximizing wealth, agreed private use turns into one of the most important issue in apartment houses. To take advantage of common parts of apartment must obtain other inhabitants' agreement and set up the protocol. Analyzing the frame of institution and improve it could release the transaction costs. Through law and economic views, this study investigate the institution of agrees private use and found that present Condominium Management Ordinance is less efficient when set the right of agreed private use because there are some problems about builder, decision forms, protocol, the contract of separate control, and the guarantee. In order to improve the efficiency of agreed private use, this study finds out the problems and discusses how to solve. To increase the benefit of agreed private use and decrease the transaction costs, recommending the builder should have some restricts to prevent inhabitants' loss. For inhabitants' uncertainty, the decision forms should have distinct along with different setting purpose. The effect of contract of separate control should reason by analogy of lease. Liability rules could be efficiency when ensure the inhabitants' right of agreed private use. To assist the conclusion of this study, suggesting that set up the professional court and appraisal system to achieve the ultimate purpose of apartment management.
