Summary:碩士 === 中原大學 === 財經法律研究所 === 96 === Online business transactions has been rapidly developed during the recent decade as well as its disputes related to or arising from the various types and models of electronic commerce. Through globalization and versatile value basis, dispute resolution mechanisms become more and more complicated to accommodate the rapid-changing online environment. Traditional court system on litigations now is not suit for online business operators and consumer expectation in certain perspectives. Therefore, online alternative dispute resolution (Online ADR)gradually becomes an optional thinking for internet society due to timely, efficient and flexible considerations. The thesis plans to first introduce recent Online ADR practical model and legislation in U.S., United Kingdom, Japan and Korea as well as policy development in international organizations. Secondly, comparative analysis will be focused on feasibility in Taiwan's online business environment to adapt online ADR. Finally, the thesis suggest online ADR mechanism can be established, such as Cyber Court and its procedure from Japan’s experience, through Taiwan's judicial reform in the near future..
