| Summary: | 碩士 === 國立臺灣海洋大學 === 海洋法律研究所 === 96 === Limitation of Shipowner’s Responsibility is developed since ancient times , its significance and development has changed with the times. This paper reports legislation and the spirit of the liability limitation of shipowners and analysis evolution of the International Convention ,and next to study the development trend of the current system.
This paper also compares liability limitation of shipowners about the maritime law of Taiwan and Mainland China, discuss the legislative history from the two sides and gradually enter the comparision on substantive law regarding maritime law of Taiwan and Mainland China ,to study all the differences points of the policy between Taiwan and Mainland China , further we analysis this different point result of impact and finally we propose some conclusions and suggestions.
