碩士 === 國立中興大學 === 國際政治研究所 === 97 === abstract No matter judging from the history cultural heritage, geography and geology, and the angle of international legal theory, Diaoyutai Islands from time immemorial is a part of Chinese indivisible territory. The territory right belongs to China allthe way. People dispute for years over its sovereignty. In 1972, according to"Okinawa Return Agreement", American gave the "administrative right" of Diaoyutai Islands to Japan, resulting in the strong protest of our country and the People''s Republic of China. The United States indicates that the sovereignty problem should be solved by the related nations, denying and not supporting any nation''s sovereignty and assertion for Diaoyutai Islands. The sea accident that happened in Diaoyutai Islands on June 10, 2008 makes the ownership become a domestic and international focus again. Although the problem in Diaoyutai Islands is a contest within China, Japan, and Taiwan, the United States also plays a rather important role. So this thesis first discusses over conflict solution, peace studying method and history studying method. First this thesis discuss from"history background and the origin of the sovereignty conflict of Diaoyutai Islands", by sorting out history documents, elaborating distant cause and immediate cause about sovereignty of dispute in Diaoyutai Islands. It not only expresses history cultural heritage, legal source and research, but also analyzes, compares, and explains the related problems in Diaoyutai Islands within our country, Japan, and Liuqiu. Besides, " the problems in legal theory concerning Diaoyutai Archipelago ownership", the international law about realm right contains the law in previous occupying and inter emporal law etc. It can examine and discuss each opinion of all the legal theories. Secondly, it aims at "all countries’ assertion and analysis of the Diaoyutai Islands sovereignty". First it talks about the assertion of sovereignty in Diaoyutai Islands within Japan, the United States and China, and then refers to the assertion of Diaoyutai Islands of our country, and analyzes the assertion of Japan as well. What’s more, "discussing the problems in Diaoyutai Islands from the strategic safe angle", first it elaborates the strategic position and its importance in the northeast Asia security. Then it analyzes the strategic partner relationship between the United States and Japanese. Secondly, it describes the strategic visual field of China. Finally is expresses the strategic value and importance of Diaoyutai Islands to our country. Finally, that is the "conclusion" part. First it gives a simple and brief explanation to the studying process and result. Secondly, it points out the main research detection and possible contribution. The final part is the studying restriction and the suggestions on future research indicated by the writer
