碩士 === 國立中正大學 === 勞工所 === 98 === The definitions of occupational accidents and the regulations of compensation systems for occupational accidents in Taiwan are scattered in the acts like the “Labor Safety and Health Act” and ” Labor Standards Act.” And,“Protection for workers Incurring Occupational Accidents Act”was enacted in 2001.In practice,all walks of life do not really review to find out the reasons of occupational accidents to reduce the frequency. Besides, there is no supplementary measures to help the workers to return the work fields.Based on the above reasons, there is this research. This study used literature reviewed method to collect the viewpoints and secondary data from domestic and overseas scholars and experts on the occupational accidents relief and vocational rehabilitation system. By exploring the difficulties of economy and returning the work fields the labor encountered after occupational injury to review the related issues and regulations on occupational accidents compensation and vocational rehabilitation in our country. Referring to the domestic and overseas scholars’and experts’publication and analyzed them,the framework of this study is set up and in final some arguments and suggestions are proposed for the reference of all walks of life. The relief of our vocational injuries can be classified as compensations according to the“civil law”and injury indemnities according to ”Labor Standards Act.”Vocational Injury indemnities are composed by the payments under the“Labor Insurance Act”, the vocational injury grants according to ” Labor Standards Act”and different kinds of subsidies and allowances under the ”Protection for workers Incurring Occupational Accidents Act. ”However, the concepts of vocational rehabilitation are valued until the “ Protection for workers Incurring Occupational Accidents Act”was enacted. The first three chapters focused on the related legal issues on occupational accidents reliefs. In chapter 4 the importance of vocational rehabilitation to the injured workers and the possibilities of including of them in physical and mental disabilities are discussed. For those who can not return the work fields, the related study and analysis on social welfares policies are proposed. In chapter 5 the present situation of vocational rehabilitation in our country is discussed. At the end, the conclusions and suggestions are made in chapter 6. This study find out the real vocational accident compensations are composed of prevention beforehand and the vocational rehabilitation later which is called a complete compensation systems for occupational accidents. Essentially considering the standings of weak labor, the amendments and integrations of related resources will help the injured workers to return the vocational fields smoothly. In this way, the workers’ rights are protected and the safe and healthy work environments are created.
