Summary: | 碩士 === 中華大學 === 行政管理學系碩士班 === 98 === Since the government lifted the martial law on July,15th, 1987 and the ban on visits to relatives or family members in Taiwan by mainland residents on Nov.2nd, in the same year, the exchanges across the Taiwan Strait have become increasingly frequent. In recent years, however, with cross-strait marriages increasing, it has become extremely easy for mainland spouses to gain permission to come to Taiwan to visit or stay with their family members. This has allowed the human smugglers a great opportunity to gang up with illegal prostitution business operators to introduce the mainland “brides” to Taiwan for providing sex services. The cases of “whoredom under the cloak of marriage” are alarmingly numerous due to the lack of effective platform between Taiwan and mainland China for communication and coordination on this matter.
The purposes of this study are: (1) to explore the background of the formation of the false marriage rings and develop preventive measures. (2) to analyze the connection of danger factors (such as age gap, education level, remote areas, etc.) between the residents of Taiwan and mainland China to find the differences between true and false marriages. (3) to provide the interviewers in-depth understanding of false marriages for easier detection and less cases of misjudging the innocent.
A huge wealth gap has formed and unemployment aggravated among the vast population in the Chinese mainland since the adoption of the reform and opening-up policy, forcing a plethora of jobless people and residents in farm villages to leave their hometowns to make a living. Meanwhile the pervasive manpower shortage in the low-end labor market of Taiwan has provided an opportunity for the oversupplied mainland residents to fill these job vacancies. In addition, the relatively high wages in Taiwan have become a lure for the mainlanders to take a risk to come to the island for work in the guise of marriages. However, their entry via false marriages may have impacts on the Taiwan society in the following aspects: (1) national security. (2) public order. (3) national health. (4) increased burden of social welfare. (5) the job market. (6) surging costs of examination and management. (7) damage to law enforcement credibility.
After reviewing the current interview system in Taiwan, it is confirmed that the false husbands tend to be of the middle and low ranks (namely population with low education, low economic conditions and unemployment). The people entering the false marriages do not have the ability to complete these actions and therefore rely on the middlemen to do the jobs.
Based on the study mentioned above, the danger factor indicators of the people porn to entering the false marriages and their rating standards are as follows: 1.Age group (41-50 years old) →3 point. 2. Age gap (0-9 years) →3 point. 3.Birth place (Yilan , Hualien and Taitung) →3 point.4.Education level (elementary school、senior high school) →3 point.5. Occupation (unemployed、
worker) →3 point. 6. Economic condition (barely enough) →3 point, 7.No wedding banquet→3 point. 8.Aboriginal group→3 point.
The above danger factors are divided into 8 items with a total score of 8 points and the danger levels are divided into (1) 1-9 points, the dangerous level ;(2) 10-19 points ,highly dangerous level and (3) over 20 points,extremely dangerous level.
The unlawful conducts of the false marriage brokers are encouraged by lax review, ample profits, differing views on judicial judgments and low penalties with little deterrence. Neither are these cases regarded as severe ones by the law enforcement bodies and actively addressed with investigative and preventive measures. The interplay of these passive factors has caused the number of false marriage cases to rise to a shocking level.
