博士 === 國立政治大學 === 歷史研究所 === 98 === A lot of political cases appeared between late 1940s and early 1990s in post-war Taiwan. The major issues that the dissertation would like to discuss were: After all, how were these political cases disposed in different process of disposal ? Especially, how were they disposed in an improper even illegal way ? How were human rights infringed in the process of disposal ? And the dissertation deliberated upon the structural factors of political cases that emerged in an endless stream during the White Terror era. The dissertation aimed at the dimensions/ process of system, legal system, investigation, trial, ratification and review, and execution to make a deepgoing exploration. Among them, “Strongman authoritarian party-state system” was the core system that produced political cases. The authorities used this system that departed from democracy and human rights as the engine; therefore, they produced numerous political cases under exercise of legislative power, administrative power, and judiciary power (military law) at will in the White Terror era, and this was exactly the structural factor of political cases that happened again and again during the White Terror era. Besides, the influential dimension of White Terror was deep and extensive. Its human right infringement in freedom of person, freedom of expression, and freedom of assembly and association was particularly direct and conspicuous. The dissertation also paid close attention to how the human rights were infringed in the process of improper and illegal disposal.
