An Analysis of Implementation Effects of Foreign Worker's Care Service Plan:Viewpoints of Foreign Worker Inspectors in New Taipei City

碩士 === 國立中正大學 === 勞工關係學系暨研究所 === 99 === Since the Taiwanese government allowed foreign workers to work in Taiwan, the employers has been responsible in taking care of foreign worker’s living. The “Foreign Worker's care service plan” has been developed from November 2006 to inspect employers’ responsibility. After four years, some unreasonable events constantly happened. To find out the gap between the policy expectation and reality, this research intends to investigate the implementation status and possible influential factors. In-depth interview is adopted by interviewing 17 persons, including 1 Foreign Workers Administration Division Of Introduction to the Bureau of Employment and Vocational Training,Council of Labor Affairs, 1 Foreign workers Service Section Of Labor Affairs Department, New Taipei City Government chief, 2 Foreign workers Service Section officers and 13 foreign worker inspectors. The major findings are the following: The present implementation of the plan reveal that foreign worker inspectors will make integrated judgments basing on regulation, case circumstance and foreign workers’ preference with respect ot food, accommodation and leisure. Up to now, food providing has no violation while some employers cannot abide by the regulation of accommodation and leisure. Concerning the 8 items discussed in this research, one has no genuine benefit for foreign worker’s living; two have no significant benefit for foreign worker’s living, and one is only a spiritual guidance. Therefore, the 8 items of the Plan shall be adjusted to ameliorate their effects on foreign worker’s living. Reasons behind such implementation include foreign worker inspectors’ heavy workload, inspectors’ viewpoints with respect to regulation and the administrative discretion flexibility. Finally, this research proposes some suggestions to the central competent authority, the local competent authority, foreign worker inspectors and future researchers.
