| Summary: | 碩士 === 逢甲大學 === 財經法律研究所 === 99 === Litigation is the traditional means of dispute settlement, while most disputes in the professional sports industry resort to arbitration, which can make the settling process more effective basing on the diversity of cases. The players, players association and owners in the professional sports industry of the United States, by signing the Collective Bargaining agreements, voluntarily file disputes to the impartial arbitrator instead of courts.
This research will major in the main disputes settlement means of professional baseball industry, arbitration. By choosing arbitration system of MLB as observing objective, comparing its legal framework to Taiwan’s and figuring out the shortcoming in protection for players in Taiwan from the gaps between two countries, this research wishes to provide concrete advises promoting to build a fairer dispute settlement mechanism with sufficient protection to the players for Taiwan.
