碩士 === 逢甲大學 === 財經法律研究所 === 100 === The economic analysis of law, as emerging research methods in the field of legal study, has become popular in the recent decades. The theoretical interpretation of legal definitions and terms are replaced by the economic efficiency analysis of cost and efficiency. The Intellectual property law, compared with other areas of law, is more advanced in adopting the economic analysis method as a research method. Many fundamental research in the intellectual property field are accomplished by economic analysis method. Established on the incentive theory, the patent law is a suitable topic for review the economic analysis as a legal research method. The patent infringement compensation as a pure monetary compensation is calculated as results of economic analysis, which could not be separated from economic analysis of law.Therefore, the purpose of this thesis is to study the United States courts application of the economic method on calculating the monetary relief in patent infringement cases.
