Summary: | 碩士 === 國立臺灣大學 === 國家發展研究所 === 100 === The Control Yuan’s power of corrective measures offers a wide range of topics to be explored in academic research, from the subjects and objects of the corrective measures power and questions involving procedures, properties, efficacy, authority and systems, to practical differences between the corrective measures power and the power of legislative oversight and their relative merits. In addition to analyzing the discourse on the limits, elements and efficiency of corrective measures from legal, theoretical and practical perspectives, this paper uses empirical data to explore the current situation with respect to the Control Yuan’s exercise of corrective measures. This analysis affirms the efficacy of the corrective measures power and its standing in the Constitution. The study concludes by offering some suggestions for improving the effectiveness of corrective measures.
This study focuses on the structure of committee sessions and the exercise of the power of corrective measures by reviewing corrective cases approved by the Fourth Control Yuan from August 1, 2008 to July 31, 2011. The study is comprised of five chapters. The first chapter is an introduction outlining the motivation, purpose, methodology, design and limitations of the study. The second chapter is a literature review that covers terminology, an overview of the separation of powers, committee organization, legal theory and other theoretical foundations. This section also reviews and evaluates some of the relevant domestic literature. The third chapter discusses the legal debates surrounding the Control Yuan’s corrective measures- with a particular focus on the timing, elements, and effectiveness of each corrective measure- based on a review of current regulations, theories and case studies. The fourth chapter identifies a number of outcomes related to the Control Yuan’s corrective practices. In addition to a discussion of the subject and object of corrective measures, this chapter employs statistics and quantitative methods to present the survey results in four dimensions, thus reflecting the current situation of the exercise of corrective measures. The final chapter concludes with the findings of the study and offers suggestions for potential follow-up studies focusing on the power to propose corrective measures.
