碩士 === 國立中正大學 === 法律學研究所 === 101 === There are many kinds of merchandise and widely used in the life, such as the eraser、baby wheelbarrow、helmet and electric appliances. Therefore government should make sure the merchandise which currency in the market are safety to ensure ones life、body and property. The certification and registration as the merchandise safety management system in our country, which can connect to international and reduced trade barrier. By quote national standard as inspection standard to determine the conformity of merchandise inspection. The national mission become various and professional due to society progress and technology develop, but if all administration measures are execute directly by nation, perhaps produce heavy loading problem. So, need escape tradition thinking to guide non-governmental participate in administration matters and assist administration organizations execute mission. Therefore “merchandise certification and registration system” guide in two non-governmental (appoint laboratory and certification body) to assist organizations execute merchandise experiment 、investigate and issue certifications. The two non-governmental participate in the merchandise certification and registration system also produce some law issues. The law issue between “administration organizations and appoint laboratory” are their law relation、 who need responsibility for the experiment report、formality or substance investigate for the report which is release by appoint laboratory、the relief channel when people is not accept for the test report. The law issues between “administration organizations and certification body” are who has the authority to abatement or abolish the certification、the relief channel when people is not accept for the abatement or abolish disciplinary action. The author anticipate the thesis is aid for administration organizations、judiciary and academic research.
