Both of them are outstanding representatives of third-party payment service for foreign and domestic industry. The author wish to examine the laws and regulations by analyzing PayPal and 8591.com. And try to find the problem about application of law. In this paper, third-party payment service were classified as two types, (a) independent operating cash flow of information and (b) concurrently e-commerce pay services platform. The main concept of these two types is “i-Escrow”. Without “i-Escrow”,the third-party payment service will lose the most attractive part. Then, the author discusses about the torts may produce by the third-party payment industry. Third, the author divide it into three oriented to explain the relationship between respective rights and obligations. Fourth, try to find the reasonable standards through risk allocation and compare the difference between domestic and foreign. In the end, the author proposes some ways to manage the third-party payment industry effectively, and affirmed the government is doing.
