| Summary: | 碩士 === 南台科技大學 === 財經法律研究所 === 101 === The infringement lawsuits about the dealers of Kara-OK Television (KTV) never suspend. The most impressive one is the infringement lawsuit between the copyright collective management organization, MÜST, and the dealer of KTV chain store, Holiday. This thesis sorts some judgments in recent years in Taiwan to clarify what kind of the dealer's acts will infringe on the rights of the copyright owner, and then leads to the issues between the two parties. In addition, the paper also research on the relevant judgments in Japan, which has the approximate culture of KTV, and compares the controversies and doctrine differences between Taiwan and Japan. Then also refers to the theories and the opinions of practice in the United States and Japan to find out the deficiencies of the system in Taiwan.
The study is divided into six chapters, and discusses on the issues of the verdicts concerning KTV lawsuits individually, then compare the foreign views with the opinions in Taiwan. At last, the article investigates into the effects upon the amendment of the review system in Copyright Collective Management Organization Act, and makes some suggestions of improvement for the Act from the advantages of the foreign review system.
