碩士 === 輔仁大學 === 法律學系碩士在職專班 === 102 === Key word： A Study on the Minor Children Guardianship The regulations of guardianship of minor children are only seen in Civil law and associated regulations in the past, and can not protect the rights of minors. Although multiple amendments of Civil law had been made and Children and Youth Welfare and Protection Act followed by Family events Act had been effective upon promulgation, the regulations are seen in diverse fields and thus are not as efficient in use. The development of the guardianship of minor children has been evolved to prioritize the rights of minor children. Although this development is becoming the mainstream in modern societies worldwide, the idea of“in the childrens best interest' principle”is still not clearly defined in law. The development of minor children is important for a society and it is therefore the responsibility for authorized institutions in the government to take it seriously. Eventually, relevant duties associated with the guardianship of minor children would be critical for a modern society. In this work, from the history of the guardianship of minor children, we discuss the origin of the guardianship and the flaw of laws. Based on the findings of this study, we propose suggestions for amendments of laws.
