The government revised the laws to enhance the capability and set up the Bureau for Disaster Prevention and Response in order to reduce the impacts. And meanwhile, the military always be regarded as an important helper in disasters by the public sectors. In this paper, literature review and in-depth interviews were the methods to explore the dilemma when the military intervene the civic affairs deeply and weaken the institution of disaster prevention in local. This paper compares the relevant experiences among the United States, Japan and ROC in order to clarify the role of the army. The study findings include: the army would face the imbalance between disaster prevention and military trainings. This embarrassment will affect the cognition and self identity of soldiers, and make the local government depending on the resources from military seriously. The National Defense Act and Disaster Prevention and the Protection Act are created the legitimacy for the army to intervene non-military affairs. Furthermore, disaster prevention is domestic affairs, the military normality would affect the operation of democracy. It is danger to destroy the division among different sectors. We should professionalize the military and reconstruct the system about disaster prevention, and let the local government take accountability.
