Summary:碩士 === 東吳大學 === 法律學系 === 102 === Abstract Those trafficking, montgaging, exploitation and insult conducted targeting at“human” are not only existing in the presentime, this kind of old evil in the earliest time can be retraced to the phenomena of slavery and slave trading in the history.And following the development of civilization and the revealment of human rights, the slavery has been gradually casted away and abolished.However, the phenomena of human trafficking has being regarded as the rebirth of slavery. According to the analysis of International Criminal Police Organization, the problem of human trafficking with International drug trading and the terroristic activities are listed the three worst serious international crimes of world, and the benefit brought from it almost as much as the total sum gained from the grobal drug trading. Since the human trafficking has already become global phenomena, and also a crime seriously insulting the human rights, though the international communities brgan to build up related conventions in early nineteen centry so as to effectively prevent and control the problem of human trafficking, why this old crime has never disappeared along with the evolution of civilization, but contrarily getting worse? Actually what is the so called human trafficking? What are the nature and characteristics of human trafficking? What are the same things or differences between modern human trafficking and old slave trading? What is the relationship it has with other related laws? What factors cause the rise? What are the measures took by present international communities, and what the operation mechanisms are? Within this essy, I anticipate to explore the pboblem especially focus on human trafficking already with global feature, meanwhile to retrace the historial source and developing process of trafficking, mortgaging, exploitation and insult, so as to understand the factors why this old crime has never disappeared, but contrarily getting worse to transform into verious types and metoods to continuous existing in modern society. Through the clarification of the definition of human trafficking, the concept and characteristics, the forming facoors and background as well as the legal relationa with other branch of international laws to translate the interrelationship, and finally presenting the entire system of modern international anti-slavery. The another emphasis of essay is putting on exploration of legal sources, general principles of laws, as well as the mechanisms and effectiveness of modern measure forbidding slave trading, to combat the human trafficking under the framework of international law.Through the more comprehensive litegrated dual exploration of internation and domestic laws, to provide real effective remendy to combat the modern human trafficking.
