Summary:碩士 === 東吳大學 === 法律學系 === 102 === In recent years, “Payment Services” have developed rapidly and have become the topic of increasingly heated discussions. The government has promulgated the establishment of rules and regulations for the use of “Payment Services.” The Financial Supervisory Commission seems to have taken a different stance on “Payment Services.” The Executive Yuan is coordinating interagency consultations among the Financial Supervisory Commission, the Ministry of Economic Affairs, and other relevant agencies in order to establish rules and regulations pertaining to service provider eligibility, range of services, and industry supervision. However, whether the establishment of such rules and regulations will help the “Payment Services” industry to flourish is in question. Furthermore, the “Payment Services” trend in Taiwan can not be ignored. Many non-financial institutions (including but not limited to the cash flow industry, the e-commerce industry, and the gaming industry) are anticipating positive developments from the government’s interagency consultations. From whether the regulation of “Payment Services” needs its own set of rules and regulations to which government agency should oversee the industry, it has all been building up to a climax. As of April 2, 2014, the Executive Yuan has appointed the Financial Supervisory Commission as the government supervisory agency and has ordered a comprehensive review of the current draft of the proposed rules and regulations. Due to the recent progress made in the field of “Payment Services,” the Taiwan Government is currently promulgating the establishment of rules and regulations to govern “Payment Services.” Considering the relevant laws in the United States, the European Union, and the People’s Republic of China, this paper will provide research conclusions and policy suggestions with the aim of further advancing the development of “Payment Service” in Taiwan.
