Summary:碩士 === 輔仁大學 === 法律學系碩士在職專班 === 103 === In protecting the financial lives of modern day people, insurance systems can help to lower risk and reduce damages suffered in times of personal financial crises through a large amount of laws and regulations.Obligation is therefore an extremely important issue underlying insurance systems, with the foundation of obligation originating from the principles of integrity and quid pro quo in Insurance Law. The insurer relies on facts from the insuree to conduct risk assessments and calculate premiums, hence before establishing the contract, all insurers will request the insuree to inform them more about the factors that can influence a risk assessment.This paper focuses on life insurance and aims to illustrate the significance, legislation basis, and legal nature of obligation. It elaborates on the content and scope of obligation, and discusses existing operational insurance practices, financial laws, and opinions from authorities. In looking at the workings of obligation in practice, this paper is supplemented by foreign legislative cases and trends. Furthermore, recommendations are provided for amendments to applicable doubtful points in the law in order to further improve the state of financial insurance.
