Summary:碩士 === 國防大學 === 法律學系 === 103 === In recent years, the number of the disabled has been continuously rising in Taiwan due to illness, accident or vocational disaster. The disabled have difficulties not only in interacting with social environment, but also in self practice, and they thus one the relative minority group in society. Because of the aforementioned, the government builds up many dimensional rules to protect their rights. This essay will take Regulations on Subsidization for Living Subsidy for the Disabled as a studying point for issue analysis. To prevent people’s over-reliance on the government, living subsidy sets up some certain standard on asset as a filter. The criterion authorized by subsidy regulations and Public Assistance Act. The local, municipal or county agents have administrative discretion in decision-making based on the best interest of applicant. It’s necessary to examine the role of agent that plays in the investigation process, the limits of its decision and the influence on applicant’s rights by the agent’s decision. In order to criticize drawbacks of the regulations in face and provide a proposal for amendment of regulations, this essay will examine regulations of both central and local governments, and cases will be also provided as evidence for analysis.
