| Summary: | 碩士 === 國立臺北大學 === 法律學系一般生組 === 103 === Before decades, Aging Society had became a global problem, which the hardest part of it is “Aged Economic Security”, including social insurance, work pension, public annuity…and so on, have been practiced abroad in western world for many years. However in here, eastern asia, with the affection of traditional filial piety conception, most family would take in charge of the aged member’s nourish, which caused our public annuity system founded so late that legislated till recent years, though still incomplete. It needs time to get to the best solution, what we can do now is to build and improving the private or group commercial annuity insurance market, for the purpose of establish an ideal welfare country.
According to the current law of annuity insurance in our nation, there are obviously stipulate insufficiency and several provisions improperly applied to life insurance, especially upon the legal effect of premium unpaid, which is the main issue of this thesis.
The paragraph combines two separated topics, the character of annuity insurance and legal effect of premium unpaid, which through collecting present regulations, official made model contract and actual annuity insurance policy, to analysis this topic. At first, it would start from introduction of annuity insurance, contains it beginning and development history. Then it comes to discuss about premium related issue. In the end, it would compared these opinions then source out the legislative suggestion, as the conclusion of this thesis.
