An Analysis on Patrolling Missions in Western Central Pacific by R.O.C Coast Guard Administration – A Research toward Boarding and Inspection Measures

碩士 === 中央警察大學 === 水上警察研究所 === 104 === 1 January 1990, R.O.C. government established the modern maritime law enforcement force, the Seventh Special Police Headquarters of the Police Administration, Ministry of Interior. At that time, its two main missions were: 1) To Conduct the inspection and seizure of stowaways and smuggling guns and ammo, explosives, drugs, and to cooperate the seizure of illegal imports that against the customs regulations. 2) To cooperate with Council of Agriculture in fishery patrols inshore and overseas. In 1998, the Seventh Special Police Headquarters of the Police Administration was reorganized as Maritime Police Bureau, and its Special Mission Flotilla officially started to conduct the overseas fishery patrols. In 2000, Coast Guard Administration (CGA) was established. There are two subordinate institutions to CGA, Maritime Patrol Directorate General (MPDG) and Coastal Patrol Directorate General (CPDG). The missions of Maritime Police Bureau were handed over to MPDG which is responsible for all kinds of incident at sea. CONVENTION ON THE CONSERVATION AND MANAGEMENT OF HIGHLY MIGRATORY FISH STOCKS IN THE WESTERN AND CENTRAL PACIFIC OCEAN was approved by the 7th session of the Multilateral High-Level Conference on the Conservation and Management of Highly Migratory Fish Stocks in the Western and Central Pacific held at Honolulu, Hawaii, 30 August to 5 September 2000. After that, Western and Central Pacific Ocean Fisheries Commission (WCPFC) was established in 2004. For ensuring sustainable fishing resource, WCPFC approved Western and Central Pacific Fisheries Commission Boarding and Inspection Procedures on 15 December 2006 to prevent illegal, unreported and unregulated fishing by creating a system that registered official ships of a member can inspect fishing boats of other member at high seas. Although MPDG is not the authority of management of fishing resource, it is MPDG that is the authority of maritime law enforcement and is responsible for conservation of living resources at sea by the laws. Since R.O.C. is a member of WCPFC, MPDG has the responsibility to conduct boarding and inspection to other member’s fishing boats at high seas, which is an exception to freedom of seas. For above reasons, it is necessary to discuss and review the intensions and the essences of this newly built scheme. Therefore, this study brings up the provisions about boarding and inspection at high seas of CONVENTION ON THE CONSERVATION AND MANAGEMENT OF HIGHLY MIGRATORY FISH STOCKS IN THE WESTERN AND CENTRAL PACIFIC OCEAN and other relevant regulations, then analyzes some representative cases. As the result, some suggestions come up for MPDG to conduct boarding and inspection at high seas abiding by the convention.
