Summary:碩士 === 逢甲大學 === 土地管理學系 === 104 === Land expropriation is a measure for government to expropriate people’s property in order to meet the need of establishing any undertakings for public interest purposes. Procedures of expropriation must be legal, and its compensation should be appropriate to assure the rationality and fairness for compensation. According to the latest amended Land Expropriation Act, the value of expropriated land shall be compensated based on its current market value. The market value of the expropriated land was determined first by selecting the most representative land parcel within a land section and value it as the benchmark in the section. Then, the benchmark land is used to assess the market values of all the other land parcels within that land section. Also, the value of land reserved for public facilities in the urban planning area shall be compensated based on the average market value of its adjoining lands which are not reserved for public facilities. Hence, the assessment value derived from the benchmark land method should greatly affect the people’s property. Currently, the selection of the benchmark land is only judged subjectively by the land management offices of local governments, or by the real estate appraisers, based on their professional experiences. The current land value assessment lacks systematic analysis with scientific methods. This mechanism does not assure the fairness and public confidence of the assessment results. In this study, valuation of land expropriation compensation was designed with the use of GIS and descriptive statistical method to select the benchmark land. The proposed procedure had been proved and testified effective on selecting the benchmark land for land management offices and real estate appraisers.
